1. Acceptance of the Terms of Use
1.1 Acceptance of the terms of use set out below regulates the use of the website www.juiceplus.com . This website is operated by The Juice Plus+ Company (hereinafter referred to as “Juice Plus”).
1.2 Please read these Terms of Use carefully before using the Juice Plus+ Website. By using this Website, you agree to be bound by these Terms of Use. Users may only access the Website by accepting the Website Terms of Use.
2. User Types
2.1 Any person using the Site represents and warrants that they are eighteen (18) years of age or older, or, if the person is under eighteen (18) years of age, that they are at least thirteen (13) years of age and that their parent or guardian, having certified and accepted these conditions, is aware of their access to the Website and consents thereto.
If the User does not accept these Terms, the User must not access or use the Site in any way.
3. Confidentiality
3.1 Users must read and understand the terms of Juice Plus+'s Privacy Policy which can be found here or at the bottom of the Juiceplus.com page. This policy is incorporated into this Agreement by reference as if set forth in full herein.
4. Links from Third Party Websites
4.1 You may have reached the Juice Plus+ website from a link on another website. If this is the case, we want you to know that this website is not controlled by The Juice Plus+ Company. As such, The Juice Plus+ Company cannot be held responsible for the content of the website containing the link, or any other website to which it may link. We provide these links for convenience only, and they do not constitute or imply any endorsement by The Juice Plus+ Company of the content of any of the sites containing these links.
4.2 Links to content from other providers must be distinguished from the content of Juice Plus+. Juice Plus+ does not verify the content of these links. If Juice Plus+ discovers or is informed by these third parties that the content of the third-party website or document to which Juice Plus+ has provided a link gives rise to liability under civil or criminal law, Juice Plus+ will promptly remove the link to this offer.
5. Registration
5.1 Certain pages of the Juice Plus+ website may be password protected. Access to these pages is only possible for registered users. No registration with Juice Plus+ is necessary. If a user wishes to register, the user must provide truthful information and indicate any possible subsequent changes to the information required for registration upon next use.
5.2 The user is solely responsible for the security of his password. It is not permitted to reveal it to third parties. If unauthorized persons discover the password, the user must immediately change his password.
6. Copyright
6.1 All content on this website, particularly logos, videos, films, photos, text, company names and trademarks, is protected by copyright. Users may not reproduce, modify, copy, resell or use the intellectual property or any other content of the Juice Plus+ website, for commercial or non-commercial purposes, without prior written consent from Juice Plus+.
7. Disclaimer
7.1 The Juice Plus+ Company prohibits the use of privately produced materials to promote the performance or characteristics of Juice Plus+ products. Therefore, you must only use product descriptions found on this website or in other official Juice Plus+ materials.
7.2 This website and its content are designed to comply with laws and regulations. It is designed to be accessed and used only by users in their country of residence. Marketing regulations may vary from country to country. Therefore, use only official Juice Plus+ materials created for use in your country.
8. Warranty
8.1 Juice Plus+ does not warrant that the Site or Services will meet the User's requirements, or that the Services on the Site will be uninterrupted or error-free, or that defects in the Site will be corrected. The content and services available on the Site are provided "as is" and "as available".
8.2 The terms, information and features included in the Terms of Use may change at any time, without notice. By accessing or linking to these Terms of Use (to the extent that linking is permitted), the Customer represents and warrants that it assumes the risk that the information may have been modified or deleted since the last access.
8.3 Juice Plus+ reserves the right to modify, update, add, discontinue, delete, revise or otherwise change any portion of these Terms, in whole or in part, at any time. In order for changes to these Terms to be considered valid, Juice Plus+ will provide reasonable notice to customers on the Website.
9. Services
9.1 The Juice Plus+ Company sells its branded nutritional products and dietary supplements (“Products”) to its end consumers (“Customers”) from its website juiceplus.com, which includes all relevant subdomains (“Website”) and through its independent Juice Plus+ partners (Independent Contractors).
9.2 Any order (“Order”) received by Juice Plus+ in accordance with clause 10.1 is accepted by Juice Plus+ in its sole discretion. The Order is accepted and the contract (“Contract”) is finalised when the Customer (i) receives a confirmation email from Juice Plus+; and/or (ii) receives the Products.
9.3 Standing Orders are defined as continuous orders, expressly accepted by the Customer, and consist of recurring deliveries every four (4) months (“Standing Orders”).
9.4 If you submit a recurring order, you and Juice Plus+ are entering into a contract for an indefinite period, and you both have the right to cancel it. If you cancel a recurring order during a payment cycle, all remaining payments for your cancelled order will be processed according to the scheduled schedule, unless prior arrangements have been made. Orders must be cancelled within seven (7) calendar days of your recurring shipment date to prevent the next shipment and charges to your payment method.
9.5 Before submitting an Order, the Customer may choose between full payment or four (4) monthly installments. The Customer represents and warrants that Juice Plus+ may refuse payment of an Order by installments.
9.6 Prices shown on the Website exclude taxes.
9.7 In the event that the customer places different orders, the customer may choose, for each order, to opt for full payment or for four (4) monthly payments.
9.8 The Customer represents and warrants that once the order is submitted to Juice Plus+, it is no longer possible to modify it. To make any changes once the order has been submitted, the Customer must contact the Juice Plus+ Customer Service Center by email at [email protected] or by telephone at 1-800-668-8980 .
9.9 All Products are offered subject to availability, and Juice Plus+ reserves the right to impose quantity limits on any order, to reject any order, in whole or in part, or to discontinue Products, without notice, even if the Customer has already placed an order.
9.10 The Customer may cancel an order at any time by creating a personal account from My Account on the juiceplus.com website or by calling the Juice Plus+ Customer Service Center at 1-800-668-8980 .
9.11 Orders placed directly from the juiceplus.com website are assigned to local field partners who will be able to assist the customer if needed.
9.12 For exempt customers, please email our Customer Experience Team at [email protected] to place your order; please include a photo of your exemption card. 10. Shipping and Delivery
10.1 All requests for deliveries by the Customer are binding only when expressly accepted and confirmed in writing by Juice Plus+. The Customer acknowledges and affirms that only dates or deliveries notified in writing by Juice Plus+ to the Customer are binding and enforceable, unless clause 10.2 applies. Juice Plus+ may, at its discretion, choose different shipping methods.
10.2 The Customer represents, warrants and agrees that: (i) Juice Plus+ shall not be liable for any delays incurred due to events beyond the reasonable control of Juice Plus+ or due to force majeure events; and (ii) such delays shall not relieve the Customer from the Contract.
10.3 You acknowledge and agree that Juice Plus+ is no longer responsible for delivery of the Product once the Product has been delivered to the specified address.
10.4 Shipping charges will be added at checkout. All Juice Plus+ products will be subject to a flat rate shipping charge of $6 per shipment. Healthy Starts orders will have a shipping charge of $18. If you request an alternate shipping method and we accept it, additional shipping charges may apply.
10.5 The customer acknowledges that the transfer of ownership of the product takes place only once the order has been fully paid by the customer.
11. Payment and other charges
11.1 The Order may be paid (“Payment”) using one of the following processing options: Visa, MasterCard and Bank Draft.
11.2 Payment is processed once the order has been placed with Juice Plus+.
11.3 If the Customer is late in paying, in whole or in part, beyond thirty (30) days, the amount due will be sent to a third party collection agency.
12. Returns
12.1 Juice Plus+ prides itself on the quality of its products and certifies that the products meet the highest consumer standards. However, if a customer is not completely satisfied, they may return the product within six months of the shipping date to receive a full refund.
12.2 Standing orders (second and subsequent shipments) must be returned in a resalable condition within six (6) months of the shipment date.
12.3 Standing Orders may be cancelled at any time during the installment payment cycle. Any payments outstanding at the time of cancellation will be collected at the scheduled time according to the original payment schedule.
12.4 Juice Plus+ will refund the order using the same payment method used by the customer at the time of purchase.
13. Commercial communications
13.1 By submitting an order, the customer acknowledges and agrees to receive commercial communications from Juice Plus+, in the form of emails, newsletters, etc. using the contact details provided, all in accordance with the privacy policy.
14. Enforceability and Disputes
14.1 If any clause of the Terms is declared invalid or ineffective, in whole or in part, all other clauses remain valid.
14.2 Any modification or addition to these conditions requires the written approval of Juice Plus+.
14.3 For any dispute that the parties cannot resolve informally, the parties agree that the dispute will be brought before the federal or provincial court of Ontario, Canada.
15. Liability
15.1 Customer represents and warrants that it has read the product label before consuming any product, and that it complies with any required dosage in order to avoid adverse consequences, including, but not limited to, specific health and/or physical conditions. Customer agrees to promptly provide Juice Plus+ with any notice of legal claim relating to any product and to cooperate with Juice Plus+ in any investigation.
15.2 Even if the content of this website has been created with the greatest care, Juice Plus+ assumes no liability for the timely presentation, accuracy, completeness or quality of the information provided. Liability for claims against Juice Plus+, provided that none of the personal injuries in question were caused by incorrect and/or incomplete use of information, provided that Juice Plus+ has not intentionally acted with gross negligence.
15.3 Juice Plus+ always endeavours to ensure that the Juice Plus+ website is virus free, but Juice Plus+ does not guarantee that this is always possible. Before downloading any information, the user must ensure that they have adequate security and anti-virus measures in place for their own protection and to prevent viruses that may be present on the Juice Plus+ website.
Juice Plus+, as a content provider, is responsible for its “own content”, intended for use in accordance with common law.
